100 day pause on deportations

On January 20, 2021, President Biden, through the Secretary of Homeland Security issued a memorandum directing ICE, USCIS, and CBP to review its policies and practices concerning immigration enforcement.  This memorandum rescinds many of the harsh directives put in place by the administration of President Trump and is a positive sign for noncitizens.  The memo also seeks to focus enforcement priorities on criminals and individuals who unlawfully entered the United States on or after November 1, 2020.

The memo also seeks to reinstate Prosecutorial Discretion.  This allows individuals who are not a priority for removal/deportation to seek to administratively close their cases before the immigration court.  I have represented numerous clients who are facing deportation and successfully closed their deportation cases based on their residence of long duration in the United States and strong family ties.
